English Definition
In law the term carries two distinct senses: property owned by the state and dedicated to public use or a public service, inalienable and not subject to acquisitive prescription (shores, roads, public waters); and, in intellectual property, works whose protection has expired and which anyone may freely use. For project finance the first sense governs: ports, motorways or hydro schemes are commonly built on public-domain land under a concession, so the project company holds not title to the land but only a right of use. The consequence for lenders is that security is taken over the concession and its revenue rather than over the real property, and the asset reverts to the state without payment at the end of the concession term.
