English Definition
The economic sphere owned and controlled by the state, comprising central and local government, public bodies, regulatory authorities and state-owned enterprises; it is the counterpart of the private sector. In project finance the public sector is frequently in the counterparty role, as the grantor of a concession, the off-taker giving an offtake guarantee, or the regulator, and the distinctive risk of that role is that its payment obligation follows a political and budgetary rather than a commercial logic. What experienced lenders measure carefully is the fit between the public party's contractual undertaking and its actual payment capacity and budget cycle; even where the undertaking is legally binding, a failure to appropriate or fiscal strain shapes counterparty risk independently of the contract's wording.
