Proje finansmanında alacağın takibinin gerçek belirleyicisi, borçlunun ödeme gücünden çok teminatın haciz ve paraya çevrilme kolaylığıdır; sınır ötesi yapılarda mahkeme kararının tanınması ve tenfizi, teminatın bulunduğu jurisdiction'ın icra hukuku ve yerel mahkemelerin yabancı alacaklıya yaklaşımı, tahsilatın fiili değerini ve süresini çoğu zaman sözleşmenin lafzından daha güçlü biçimde tayin eder.
English Definition
The process of pursuing an overdue and unpaid claim through legal or administrative channels to recover it from the debtor, encompassing demand, enforcement proceedings, realization of security, and, where needed, litigation. In project finance what really governs the pursuit of a debt is not so much the debtor's solvency as the ease of attaching and realizing the collateral; in cross-border structures, the recognition and enforcement of a judgment, the enforcement law of the jurisdiction where the security sits, and local courts' disposition toward a foreign creditor often determine the actual value and duration of recovery more forcefully than the contract's wording.
