Kadro fazlalığı nedeniyle işine son verilen çalışana, yasa ya da sözleşme uyarınca ödenen tazminattır; tutarı çoğu zaman hizmet süresine, yaşa ve ücret düzeyine bağlı bir formülle belirlenir. Proje ve tesis devirlerinde toplam işten çıkarma tazminatı yükümlülüğü, gizli bir borç niteliğinde bilançoya oturur ve durum tespiti sırasında ayrıca ölçülmesi gereken bir kalemdir. İşgücünün devralınıp devralınmayacağı ve bu tazminatın hangi tarafça üstlenileceği, satın alma sözleşmesinin tazminat (indemnity) hükümlerinde açıkça paylaştırılmadığında kapanış sonrası ihtilaf doğurur.
English Definition
Compensation paid, under statute or contract, to an employee dismissed on grounds of redundancy, its amount usually fixed by a formula turning on length of service, age and pay level. In project and plant transfers the aggregate redundancy-payment liability sits on the balance sheet as a hidden debt and is an item that must be separately quantified during due diligence. Whether the workforce is assumed and which party bears this liability, if not expressly allocated in the indemnity provisions of the purchase agreement, becomes a reliable source of post-closing dispute rather than a settled term.
