Bir yüklenicinin teslim ettiği işte ortaya çıkan kusur ve eksiklikleri, sözleşmesel yükümlülüğü gereği onarma ya da yenileme edimidir. Proje finansmanında bu yükümlülük ayıp sorumluluğu dönemine (defects liability period) ve tutulan teminat (retention) mekanizmasına bağlanır; işin bedelinin bir kısmının bu süre boyunca alıkonulması ya da bir teminat mektubuyla desteklenmesi, yüklenicinin geç ortaya çıkan kusurları giderme motivasyonunu ayakta tutar ve kredi verenlerin tamamlanma riskine karşı elindeki pratik kaldıraçlardan biridir.
English Definition
A contractor's contractual obligation to repair or make good the defects and deficiencies that appear in the work it has delivered. In project finance this obligation is anchored in the defects liability period and the retention mechanism, whereby withholding a portion of the contract price over that period, or replacing it with a security bond, keeps the contractor motivated to cure latent defects. It is one of the practical levers lenders hold against completion risk, since the retained sum is released only once the period expires clean.
