İnşaat sektöründe yüklenici ve taşeronların iş bedeli ödenene kadar tesis üzerinde ileri sürebildiği mekanik hapis hakkı (mechanic's lien), kredi verenin birinci sıra teminatının önüne geçebildiğinden özel bir tehdit oluşturur. Proje finansmanında bu nedenle çekimlerin serbest bırakılması, taşeronlardan alınan hapis hakkından feragat (lien waiver) belgelerinin ibrazına bağlanır; aksi hâlde ödenmemiş bir taşeron alacağı, teminatın önceliğini sessizce bozabilir.
English Definition
A right entitling a creditor to retain possession of goods in its hands until a claim is paid, and where necessary to realize them. In construction, the mechanic's lien that contractors and subcontractors can assert over the works until their invoices are settled poses a particular threat, since it can rank ahead of a lender's first-priority security. In project finance the release of drawdowns is therefore conditioned on the delivery of lien waivers from subcontractors; otherwise an unpaid subcontractor claim can quietly subvert the priority of the collateral.
