Bir riskin gerçekleşmesi ya da bir yükümlülüğün ihlali halinde, doğan zararı gidermek veya durumu düzeltmek için sözleşmeyle öngörülen çözüm mekanizmasıdır. Proje finansmanında bu mekanizmalar bir hiyerarşi içinde kurulur: önce sponsora tanınan düzeltme hakkı (cure right), ardından kredi verenlerin devreye girme hakkı (step-in), en sonunda teminatın paraya çevrilmesi. Bu giderim sırasının sözleşmede net biçimde kademelendirilmesi kritiktir; belirsiz bir giderim hattı, temerrüt anında tarafları uzun ve pahalı bir müzakereye sürükler ve projenin değer kaybını hızlandırır.
English Definition
The remedial mechanism provided by contract to repair the harm, or correct the situation, arising when a risk materializes or an obligation is breached. In project finance these mechanisms are arranged in a hierarchy: first the cure right granted to the sponsor, then the lenders' step-in right, and finally the enforcement of security. Clear stepwise ordering of this sequence in the contract is critical; an ambiguous remedy path drives the parties into a long and costly negotiation at the moment of default and accelerates the erosion of the project's value.
