Bir tarafın sözleşmesel ya da yasal bir yükümlülüğü yerine getirmemesi halinde lehtara belirli bir tutarı ödemeyi taahhüt eden kefalet niteliğindeki sigorta ürünüdür; performans bonosu ve avans ödeme garantisi bu ailenin örnekleridir. Proje finansmanında bu poliçeler EPC yüklenicisinin ifa riskini transfer etmenin bir yolu olsa da, kritik ayrım poliçenin ilk talepte ödemeli mi (on-demand) yoksa kusurun ispatına bağlı (conditional) mı olduğudur; ikincisinde sigortacı çoğunlukla yükleniciyle aynı def'ileri ileri sürebildiğinden, teminatın nakde dönüş hızı ciddi biçimde düşer.
English Definition
A security policy is a surety-type insurance product under which the insurer undertakes to pay the beneficiary a defined sum should a party fail to perform a contractual or statutory obligation, with performance bonds and advance-payment guarantees belonging to this family. In project finance these policies transfer the EPC contractor's performance risk, but the critical distinction is whether the policy pays on first demand or is conditional on proof of default; in the latter the insurer can usually raise the same defenses as the contractor, sharply slowing the collateral's conversion to cash.
