Bir sözleşme kapsamında tanımlı bir hizmeti bedel karşılığında sunmayı üstlenen taraftır; proje yapılarında işletmeci, bakım yüklenicisi, teknik danışman, hesap bankası ve benzeri rolleri kapsar. Kredi verenler için asıl mesele hizmetin kendisi kadar sağlayıcının ikame edilebilirliğidir; kritik bir hizmet sağlayıcının tek bir tarafa bağımlı, ikamesi zor bir yapıda konumlanması, temerrüt hâlinde projeyi bu tarafın performansına kilitler. Bu nedenle iyi yapılandırılmış belgeler, sağlayıcının değiştirilebilmesi için step-in ve novation hükümleri ve çoğu zaman yedek bir sağlayıcı adayı öngörür.
English Definition
The party that undertakes, under a contract, to supply a defined service for a fee; in project structures this spans the operator, maintenance contractor, technical adviser, account bank, and similar roles. For lenders the real issue is not only the service itself but the provider's replaceability: positioning a critical service provider as dependent on a single party and hard to substitute locks the project to that party's performance in the event of default. Well-structured documents therefore include step-in and novation provisions to enable substitution, and frequently a standby provider on reserve.
