Bir poliçe ya da malın, standart koşullardan sapan özel şartlar altında kabul edilmesidir; genel kabulden farklı olarak belirli bir çekince ya da koşul taşır. Ticari finansmanda özel kabul, akreditif ya da tahsil işlemlerinde belgelerdeki bir uygunsuzluğun (discrepancy) alıcı tarafından açıkça onaylanması anlamına gelebilir. Uygulamadaki nüans şudur: özel kabul, bankanın koşulsuz ödeme yükümlülüğünü değiştirir ve rücu hakkını etkileyebilir; bu nedenle taraflar kabulün kapsamını dar ve yazılı tutmaya özen gösterir.
English Definition
The acceptance of an instrument or goods under special terms that depart from the standard, carrying, unlike a general acceptance, a specific reservation or condition. In trade finance a special acceptance may mean the buyer's express approval of a discrepancy in the documents under a letter of credit or collection. The nuance in practice is that a special acceptance alters the bank's unconditional payment obligation and can affect the right of recourse, so parties take care to keep its scope narrow and in writing.
