Tarafların her hükmü ayrı ayrı müzakere etmesi yerine, önceden hazırlanmış ve genellikle tek tarafça belirlenmiş standart koşullar üzerinden kurulan sözleşmedir; tip sözleşme ve iltihakî (adhesion) sözleşme bu ailenin örnekleridir. Standartlaşmanın işlem hızı ve öngörülebilirlik kazandırması yanında, pazarlık gücü zayıf tarafın koşulları kabul etmekten başka seçeneği kalmaması riski taşır; bu nedenle birçok yargı bölgesi standart koşullara karşı yorum ve içerik denetimi kuralları geliştirmiştir. English Definition
A contract concluded on pre-prepared, generally unilaterally set standard terms rather than through separate negotiation of each provision; standard-form and adhesion contracts are examples of this family. Alongside the transaction speed and predictability that standardisation confers, it carries the risk that the party with weaker bargaining power has no option but to accept the terms, which is why many jurisdictions have developed rules of interpretation and substantive review directed at standard terms. In project finance, interconnection agreements, grid-access, and public-utility contracts are frequently on standard terms; though the developer cannot negotiate these provisions, it can often influence the risk allocation through indirect channels such as regulatory filings and tariff challenges.
