Proje sigortalarında bu ilkenin en görünür sonucu, halefiyetten feragat (waiver of subrogation) hükmüdür; ortak sigortalı konumundaki sponsor, yüklenici ve kredi verenler arasında sigortacının birine karşı rücu etmesini engelleyerek proje taraflarını birbirine karşı davadan korur. Bu feragat olmadan, bir hasar sonrası sigortacının rücusu proje ekosistemini içeriden dava yükü altında bırakabilir.
English Definition
The legal principle by which a party that pays a debt or indemnifies a loss automatically succeeds to the rights and security of the original creditor. In project insurance the most visible consequence of this principle is the waiver of subrogation, which, among sponsor, contractor, and lenders as co-insureds, bars the insurer from recovering against any one of them and thereby shields the project parties from litigation against each other. Without that waiver, an insurer's recovery after a loss could burden the project ecosystem with claims from within.
