Bir ekspertizin bulgularını, tarafların huzurunda ve resmî bir belge (tutanak) formunda tespit eden düzenlemedir; denizcilik ve dış ticarette hasarın, eksikliğin ya da malın durumunun ihticaca salih biçimde saptanmasını sağlar. Tutanağın gücü, düzenlendiği andaki durumu zaman damgasıyla sabitlemesinden gelir; sonradan doğan bir ihtilafta hasarın teslim öncesi mi sonrası mı oluştuğu çoğu kez bu belgenin tarihine ve içeriğine dayanılarak çözülür. Akreditif ve emtia finansmanında bu tür tutanaklar ödeme koşulunun bir parçası olabilir.
English Definition
An instrument that records the findings of a survey in the presence of the parties and in the form of a formal act, so that in shipping and foreign trade the damage, shortage or condition of goods is established in a manner admissible as proof. Its force lies in fixing the state of affairs at a given moment with a timestamp; where a dispute later arises over whether damage occurred before or after delivery, it is often resolved by the date and content of this document. In letter-of-credit and commodity finance such acts may form part of the payment condition.
