English Definition
Legal processes aimed at keeping a financially distressed enterprise alive through restructuring and rehabilitation rather than liquidating it; Chapter 11 in the United States and equivalent composition or reorganisation regimes carry this logic. Their defining feature is a moratorium, an automatic stay halting creditor enforcement, that gives the debtor breathing space and time to negotiate a restructuring. In project financing, secured lenders' privileged position in such proceedings depends on how the security package is constructed and on the robustness of the bankruptcy-remote structure.
