Bir sözleşmedeki belirli hüküm ve koşulların, taraflardan biri lehine belirli bir işlem ya da dönem için uygulanmamasının kabul edilmesidir. Finansman belgelerinde bu tür feragatler çoğu zaman bir çekiş öncesi karşılanamayan ön koşullar için verilir; kredi verenler eksik bir belgeyi ya da yerine getirilmemiş bir teknik şartı geçici olarak feragat ederek kapanışı ilerletir, ancak feragatin kapsamı ve süresi risk yükünü sessizce yeniden dağıtır. Feragat edilen koşulun daha sonra yerine getirilmesi çoğu zaman bir sonraki çekişin kendi ön koşuluna dönüştürülür.
English Definition
The agreement that specified terms and conditions of a contract will not be applied, in favour of one party, for a particular transaction or period. In finance documents such waivers are frequently granted for conditions precedent that cannot be met before a drawdown; lenders advance the closing by temporarily waiving a missing document or an unfulfilled technical requirement, yet the scope and duration of the waiver quietly redistribute the burden of risk. Later satisfaction of the waived condition is often turned into a condition precedent to the next drawdown.
